Key obligations at a glance
Under Ecuador's LOPDP, organizations in this sector must address the following minimum requirements:
- DPO registration — if the organization meets the Art. 49 LOPDP thresholds for scale, habitual processing, or special category data
- Activity Treatment Register (RAT) — formal inventory of all data processing operations with lawfulness bases, retention periods, and security measures
- DPAs with technology vendors — any third-party system that accesses personal data must have a Data Processing Agreement in place
- ARCO channel — accessible mechanism for data subjects to exercise their rights (access, rectification, cancellation, opposition, portability)
- Incident response protocol — capacity to notify the SPDP within 72 hours of detecting a security incident affecting personal data
